Résumé
Les initiateurs du Traité relatif à l’OHADA, soucieux d’organiser un environnement propice au développement de l’activité économique avaient souhaité faire de l’arbitrage l’instrument privilégié du règlement des différends contractuels et de la lutte contre l’insécurité juridique et judiciaire dans la zone couverte par le Traité. Cette volonté s’est traduite par l’adoption de trois textes majeurs fixant le cadre général de l’arbitrage dans l’espace OHADA. Cette législation reconnait la pleine efficacité à la convention d’arbitrage. Par ce type d’accord, des parties à un contrat décident de soustraire les litiges pouvant en résulter de la connaissance des ordres juridiques nationaux et de leurs juridictions. Mais au Cameroun, l’on note une pratique controversée de cette règle. Ce qui pourrait, à terme, mettre à mal l’objectif du législateur OHADA. C’est pourquoi il paraît nécessaire de rechercher un moyen de restaurer la priorité de l’arbitrage afin de satisfaire à l’objectif de sécurisation.
Abstract:
In a bid to organise a suitable environment for the development of economic activities, the initiators of the Organization for Harmonizing Business Law in Africa (OHBLA) known by its French acronym “OHADA” Treaty, wished to make arbitration one of the privileged tool for resolution of contractual disputes and the fight against judicial and legal insecurity in the zone covered by the treaty. This will has been realised by the adoption of three major texts laying down the general framework for arbitration within the “OHADA” landscape. This legislation recognizes the efficiency of the arbitration convention. Following this type of agreement, parties to a contract decide to submit their contractual disputes to an arbitrator instead of the national judges or jurisdictions.
In Cameroon however, this rule has given rise to some controversy. This could defeat the objectives of the “OHADA” legislation. It is therefore necessary to seek ways and means of restoring the objectives of arbitration in order to have a secured legal environment.
